Align Technology recently filed a lawsuit against SmileCareClub, Sharper Image and Brookstone for patent infringement, false advertising and unfair competition.
Through the complaint, Align alleges SmileCareClub infringes on 14 Align patents related to the manufacture and sale of SmileCareClub’s clear aligners, according to a press release. The lawsuit asserts that Sharper Image and Brookstone infringe on 14 Align patents by marketing and selling the SmileCareClub system.
The lawsuit also says SmileCareClub, Sharper Image and Brookstone deliberately deceive and confuse patients, as well as unfairly compete with Align by making false and unsupported claims about the safety and effectiveness of SmileCareClub’s products. These products are reportedly sold without any direct contact with a dental professional.
