 ITC Ends Investigation of One Align Technology Complaint Against ClearCorrect

The U.S. International Trade Commission (ITC) recently announced that it has ended an investigation into a complaint against ClearCorrect originally filed by Align Technology in March 2012.

The complaint stemmed from Align’s contention that because employees at ClearCorrect Pakistan once worked for OrthoClear, ClearCorrect should have been bound by the terms of a 2006 Consent Order between Align and OrthoClear. The ITC’s ruling was that ClearCorrect had not violated the consent order, according to a post on ClearCorrect’s blog.

An ITC investigation of ClearCorrect based on Align’s complaint of patent infringement is still ongoing. In the blog post ClearCorrect legal counsel Mike Myers said he expects his client will prevail in the patent dispute as well.
