 3Shape Files Antitrust Suit Against Align Technology

In a recently filed antitrust lawsuit 3Shape is alleging Align Technology is illegally acting as a monopoly to block marketplace competition for intraoral scanners, orthodontic treatment, and specifically, clear aligners.

The lawsuit, filed in U.S. District Court for the District of Delaware, argues that Align is engaging in unfair practices to prevent access to its Invisalign clear aligner systems even after many of the patents protecting that technology have expired, according to a press release. Specifically, the case points to the fact that 3Shape's TRIOS intraoral scanners compete directly with Align's iTero scanners, and Align is preventing TRIOS users from using their scanners to submit Invisalign cases. The suit also points to the new Invisalign GO Treatment System that is only accessible to iTero scanner users.
