 BIOLASE Responds to Patent Infringement Lawsuits Filed by CAO Group

BIOLASE recently responded to patent infringement lawsuits filed by CAO Group, maintaining the claims are “meritless.”

CAO Group filed patent infringement lawsuits against BIOLASE in the United States District Court for the State of Utah and in the United States District Court for the Central District of California. The lawsuits involve the BIOLASE EPIC, ezlase and iLase diode laser product lines.

The most crucial claims against BIOLASE were rejected by the Patent Trial and Appeal Board, according to a BIOLASE press release, as well as the Court of Appeals for the Federal Circuit.

BIOLASE licenses some of its technology to other manufacturers for royalties, but does not license patents that are invalid or do not cover its products. CAO's claims “overlap significantly and focus on lasers with various non-differentiating feature combinations such as replaceable tips, wireless foot pedals, battery packs, laser fiber connectors, laser monitoring integrated circuits and touch screens,” according to BIOLASE. These features have been used in lasers for years and “do not represent innovations worthy of patent protection.”

BIOLASE intends to fight the lawsuits.
