 Align Technology Wins Initial Determination in ITC Case Against ClearCorrect

An International Trade Commission (ITC) Administrative Law Judge has issued an initial determination finding that ClearCorrect and ClearCorrect Pakistan have infringed on seven patents held by Align Technology, Inc.

In the ruling, the judge found that all 40 claims related to the 7 patents asserted by Align were valid and ClearCorrect’s actions infringed on 37 of those 40 claims, according to a press release. The initial determination notice from the judge does not include a recommended remedy, but Align is asking for a cease and desist order to be issued to prevent ClearCorrect from using digital data and treatment plans from ClearCorrect Pakistan to manufacture ClearCorrect aligners.

The final decision in the case is expected to come from the full ITC Commission by Sept. 4, and Align also has a federal patent suit against ClearCorrect filed in Houston, that is stayed pending the ITC Commission ruling.
